1. Seller and Acceptance
These terms and conditions govern your use of FitCasa AI, a fitness app operated by Fitpro. By creating an account, purchasing a subscription, or continuing to use the service, you agree to these Terms of Service and contract directly with Fitpro.
2. Service Description
Fitpro provides home workouts, progress tracking, nutrition and hydration tools, challenges, and AI coach features. AI-generated fitness and nutrition suggestions are informational and do not replace medical advice.
3. Accounts and Acceptable Use
You are responsible for your credentials and all activity under your account. You must not misuse the service, including unlawful use, fraud, spam, intellectual property infringement, malware, probing, scraping, security interference, reverse engineering, resale, or circumvention of technical limits.
4. Intellectual Property
Fitpro retains ownership of the service, software, documentation, branding, workouts, content, and other intellectual property. We grant you a limited, non-exclusive, non-transferable license to use the service within your selected plan.
5. Payment, Subscription, and Paddle Terms
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms.
Subscriptions renew automatically unless canceled. You may cancel at any time, and premium access remains available until the end of the paid billing period.
6. Availability and Liability
The service is provided “as is” without a guarantee of uninterrupted or error-free operation. To the fullest extent permitted by law, Fitpro is not liable for indirect, consequential, special, or lost-profit damages, and our aggregate liability is capped at the fees you paid in the previous 12 months.
7. Suspension and Termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, we may delete or anonymize account data after any legally required retention period.
